Abstract

The progeny waqf is a type of awqaf, its have a special provisions, Hold him accountable and dismissal him, as this is done by the personal status courts. while the charity waqf, Either it is managed by (the administration of waqf), or this administration   assigning the trusteeshiper , Hold him accountable, and isolated him . also its take his place him when the waqf have not trusteeshiper. Sometimes it may The progeny Waqfs without trusteeship. Here the question arises: it Is the must that (administration of Waqf) manage it, in other words, is that one of the tasks of (administration of waqf), and is it part of the objective of that administration? In particular, if we know the practical application is  is being the (administration of Waqf) in Iraq manage Those waqf in case they are without trusteeship. This research, after an exchange of views, has concluded that the (administration of waqf) should not interfere with or limit these, Because we believe that the general jurisdiction of the judiciary exists to be entrusted to those who are competent and able to administer it.
