The Legal Effects of the Division of Commercial Companies

(A comparative study between Algerian, French, and Jordanian law)

Abstract

This study sought to find out the legal effects resulting from the process of company separation in Algerian, French, and Jordanian law. It also aims to try to establish a tight legal regulation that regulates the effects of separation in Jordanian law, since, as of writing this research, there is no legal regulation of company division within legislation. Jordanian despite the importance of this process, and from here came the problem of the study in explaining the legislative shortcomings in regulating the process of division of commercial companies despite their presence on the ground, and by following the analytical approach and the comparative approach, the study reached a number of results, the most important of which is that the Jordanian legislator did not regulate the process of division of companies. Despite its existence on the ground, the study also reached a number of recommendations, the most important of which is that the Jordanian legislator regulate the issue of the division of commercial companies, which has positive effects through increasing investment that supports the wheel of the national economy.
